TERMS & CONDITIONS

1. Placing Your Order
1.1 You may place an order by adding products to the shopping cart on the BarriersRus Web Site and clicking on the appropriate submission button. You may create a personal account if you wish to.
1.2 When you place your Order, you will receive a Web Order Number. Please note that such a Web Order Number is supplied for reference purposes only and does not constitute our acceptance of your Order.
1.3 By placing an Order, you make an offer to us to purchase the Goods you have selected on these terms and conditions. We may or may not accept your offer at our discretion.
1.4 If we accept your Order, we will notify you of our acceptance by issuing an Order Confirmation. We will send your Order Confirmation to you by e-mail provided you have indicated an e-mail. Otherwise we will send the Order Confirmation by post. The Order Confirmation will be effective on sending. If we cannot accept your Order we will attempt to contact you by email or telephone or post.
2. Prices
2.1 The price for the Products will be the price indicated on your Invoice.
2.2 VAT is payable by you at the applicable rate as indicated on your Invoice.
2.3 Delivery costs, where applicable, are payable by you as indicated on your Invoice.
3. Delivery of Your Goods
3.1 Orders will not be accepted and goods will not be delivered to any address outside the mainland United Kingdom, Northern and Southern Ireland or the Isle of Man, Channel Islands or the Isle of Wight, without prior agreement
3.2 Subject to clause 4.1 we will deliver your Goods to the delivery address as shown on your Order Confirmation.
3.3 We will use our reasonable endeavours to manufacture and despatch your Goods within 3 -5 days of the date of issue of your Order Confirmation. Estimated Goods build times which are given at the time of placing an Order are estimates only and do not equate to despatch times. You may cancel your Order at any time prior to delivery of the Goods ordered by calling us on 01234 756012 and quoting your Web Order Number. Despatch times for printed products will need to be agreed directly between you and BRU United Kingdom Ltd and/or any service provider engaged by barriersRus United Kingdom Ltd. Once a delivery time for Services has been agreed then you must adhere to this.
3.4 Title to and risk of loss in your Goods will pass to you on delivery of the Goods to the address stated in your Order Confirmation.
3.5 Upon delivery of the Goods to our carrier we can send you a confirmation of shipment by e-mail provided by you indicated an e-mail address when submitting the order.
3.6 Certain items may ship by post and cannot be tracked once they have entered the postal system. All other shipments use carrier delivery for maximum security and tracking.
4. Your Rights to Withdraw from the Contract and to Return Faulty Products or Products which are not in Conformity
4.1 Right to withdraw from the contract. If you are not satisfied with any Goods or the terms of any entitlement to Services you have purchased from us, you may return the Goods to us and obtain a refund of the price of the returned Goods if you contact us within 14 Calendar Days of delivery of the Goods or entering into the contract for the purchase of Services. 15% of Cancellation or restocking Fee of the total amount of order may apply.
4.2 Exceptions to the right to withdraw from the contract. You may not return Goods and claim a refund if the Goods concerned as: a) Goods without their original packaging; or b) a personalized product such as printed tapes made in accordance with your specifications; c) heavily used goods (scratched, cracked).
4.3 Conditions to exercise the right to withdraw from the contract. You can exercise your right to return the Goods to us or cancel the entitlement to Services and obtain a refund of the price of the returned Goods or Service entitlement provided: (i) You inform us of your decision to cancel the contract within 14 Calendar Days of delivery of the Goods or the date you purchased the Services; and (ii) The Goods are returned in their original condition; and (iii) The Goods are returned in accordance with the procedure described in paragraph 5.4 below. Please note that while the Goods remain in your possession you are under a duty to ensure that the Goods are kept safe and secure.
4.4 Procedure to follow to claim a refund under your right to withdraw from the contract. (i) Please telephone us on 01234 756012 between 09:00 and 17:30 Monday to Friday to make arrangements for return. You will then be provided with an RMA (Return Material Authorisation) number. (ii) BarriersRus United Kingdom will subsequently arrange for the Goods to be collected by our nominated carrier. You will be contacted in advance to arrange for a suitable collection time and collection place. (iii) Before returning any Goods please check that you have: 1. Received a RMA number from BarriersRus (issued on request). 2. Enclosed all accessories and other material supplied unless informed otherwise. 3. Used if possible, all packaging that was originally supplied. Unless damaged while being opened, the original Goods packaging is most suitable for use for Goods returns, and unless damaged while the Goods were opened, this packaging should be used.  BarriersRus reserves the right to reject returned Goods that was damaged because it was improperly packaged during the returns process. 4. Ensure the following returns address and the RMA number are clearly displayed: FAO Returns Cranfield Innovation Centre, Cranfield Technology Park, University Way, Cranfield: MK43 0BT RMA number (please insert number on the Goods package provided to you) 5. Sealed the packaging securely. (iv) Following these steps will help ensure the Goods arrive at the correct destination and in good condition within a timely fashion. Should you fail to follow this procedure and should the condition of the goods received by BarrierRus show that you failed to discharge your obligations to take reasonable care of the Goods, your refund will be reduced.
4.5 Faulty products or products which are not in conformity. If a Product was supplied in error, is incomplete or faulty and you believe that you are entitled to a replacement or repair in accordance with paragraph 6 below, please telephone us on 01234 756012 between 09:00 and 17:30 Monday to Friday.
5. One (1) year Limited Warranty/ Three (3) year Limited Warranty
5.1 Limited warranty covers BarrierRus retractable tape mechanism only for tape cassettes and wall mounted units; it does not cover any other Products. You should refer to the relevant Product licences for warranties which may apply to your Order.
One-year limited warranty for Posts including Guideline products
Two-year limited warranty for Tape Cassettes
Two-year limited warranty for Wall mounted Belts
6. Data Protection GDPR
By placing your Order, you agree and understand that we may store, process and use data collected from your Order Form or fax Order or email Order for the purposes of processing your Order. Please note that we may also work with other companies that help us provide products and fulfil our services to you – for example we may provide your information to these companies for the shipment of Goods, etc. In addition, where you have requested finance in order to pay for the Goods ordered, some of the information you provide to us will be passed to companies providing finance for your purchase. 7. Circumstances beyond our reasonable control
We will make every effort to perform our obligations under the Contract. However, we cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control. In the event of a delay, we will perform our obligations as soon as reasonably possible.
